The Municipal Judge must be an attorney licensed to practice law in the State. The Judge can engage in the practice of law in other courts, but shall not accept employment inconsistent with his/her duties as Judge, or employment arising out of facts which give rise to or are connected with cases within the jurisdiction of the court, which might become the subject of proceedings.
Responsibilities of the Municipal Court Clerk
The Municipal Court Clerk assists the Judge in:
- Administering oaths required in proceedings in the dockets of the court
- Issuing misdemeanor criminal complaint warrants, failure to pay warrants, and failure to appear warrants
- Keeping all documents as records
- Paying the Treasurer for monies received, which is then placed into the General Fund of the City
- Performing other clerical duties related to the proceedings or to the court as directed by the Judge
- Preparing writs, processes, and other papers
- Receiving and issuing receipts for forfeitures, fees, deposits, and sums of money payable to the Court
- Recording the proceedings of the Court
